Dali Mpofu and Busisiwe Mkhwebane.
The uMkhonto weSizwe Party (MKP) leaders Advocate Dali Mpofu and Advocate Busisiwe Mkhwebane have both been involved in high-profile controversies which led the Legal Practice Council (LPC) to charge them.
Both advocates have pushed back against the LPC's charges, characterizing them as politically motivated attacks on their integrity.
Their party, MKP has condemned LPC’s actions as "political persecution masked as professional oversight." They've called for the LPC to cease its "politically motivated persecution" of Mpofu and Mkhwebane.
Mpofu faces seven charges of alleged misconduct, six of which were lodged by the Centre for the Advancement of the South African Constitution (CASAC). These charges relate to his conduct during Parliament's inquiry into Mkhwebane's fitness to hold office, including his cross-examination of former Public Protector Thuli Madonsela. Mpofu has dismissed the charges as "frivolous, laughable, and embarrassing," claiming they're a clear example of a witch-hunt.
Mkhwebane is facing a court application to have her removed from the roll of advocates. The LPC has referred the matter to its attorneys to assist in the institution of the striking-off application. Mkhwebane believes the LPC's action is politically motivated, stemming from her previous work as Public Protector, including investigations into the Phala Phala scandal and the so-called rogue unit.
Mpofu is known for his assertive and sometimes aggressive courtroom style, which has drawn both praise and criticism. He has been involved in several high-profile cases, including those related to politics and constitutional law.
Some have criticized Mpofu's conduct as overly confrontational or unprofessional, while others see him as a passionate advocate for his clients' rights.
Mkhwebane's tenure as Public Protector has been marked by controversy, with some questioning her independence and impartiality.
She has been involved in several high-profile investigations, including those related to government corruption and maladministration.
Mkhwebane has faced criticism for her handling of certain cases, while others have praised her for taking on tough issues and holding those in power accountable.
Some see Mpofu and Mkhwebane as strong advocates for justice and accountability, willing to take on tough cases and challenge the status quo.
MKP spokesperson Nhlamulo Ndhlela said: “The LPC must immediately cease its politically motivated persecution of Advocates Mpofu and Mkhwebane. All democratic forces must stand in defense of legal professionals who serve the interests of justice, not power…and Parliament and progressive legal structures must inquire into the politicisation of legal regulatory bodies, which have remained silent on judicial bias but swiftly reprimand Black lawyers who challenge the status quo.”
